Pretty straightforward, actually.
Many novelists see things wrong with their societies. They would like to see change %26amp; reform, %26amp; hope to influence the attitudes of their readers, inspiring them to support these changes, specifically in cases where they feel the laws are unjust.
The problem facing you may be an unfamiliarity with the social %26amp; legal structure of Victorian society. This calls for research on your part.
You might also check out one (or several) author studies for their take on Hardy's views.
As for his techniques, these would involve his rhetoric %26amp; presentation of argument. (This can often be done indirectly by creating sympathy for a character %26amp; a particular injustice that affects the character.)
